If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind that entity to these Terms.

# 2. Account Registration & Security

  • Accuracy: You must provide accurate, current, and complete information during the registration process.
  • Security: You are responsible for safeguarding your password and API keys. You agree not to disclose your password to any third party.
  • Liability: You are solely responsible for any activity that occurs under your account, whether or not you authorized that activity.

# 3. Anti-Spam Policy & Acceptable Use

We have a zero-tolerance policy for spam. To maintain the reputation of our IP addresses for all customers, you agree to the following:

  • No Purchased Lists: You may not use purchased, rented, or scraped email lists. All recipients must have explicitly opted-in to receive emails from you.
  • Prohibited Content: You may not send content that is illegal, phishing, fraudulent, sexually explicit, or promotes hatred.
  • High Bounce Rates: Accounts with excessive bounce rates (indicating poor list hygiene) or high spam complaint rates may be suspended immediately.

We reserve the right to suspend or terminate your account without refund if we determine, in our sole discretion, that you have violated this Anti-Spam policy.

# 4. Payment and Billing

  • Subscription: Services are billed in advance on a recurring basis (monthly or annually) or via a pay-as-you-go credit system.
  • No Refunds: Payments are non-refundable, including for partial months of service or unused credits, except where required by law.
  • Taxes: You are responsible for all taxes associated with your purchase of the Services.

# 5. Intellectual Property

Your Content: You retain ownership of the emails, contact lists, and content you upload to the Service. You grant us a worldwide license to copy and use your content solely as required to provide the Service (e.g., to send your emails).

Our Property: sendkit.best retains all rights, title, and interest in and to the Service, including our code, documentation, logos, and trademarks.

# 6. Termination

You may terminate your account at any time. We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

# 7. Disclaimer & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the service will be uninterrupted, secure, or error-free.

In no event shall sendkit.best be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, arising out of your use of the Service.
